Please read these Terms and Conditions ("Terms") carefully before using the Breatho mobile application ("App") operated by us. Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms.

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Breatho app, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access or use the App.

2. DESCRIPTION OF SERVICES

Breatho is a wellness application that provides:

• Guided breathing exercises and techniques (including but not limited to box breathing, 4-7-8 method, Wim Hof method, and various other breathing patterns)
• Meditation sessions with audio guidance
• Session tracking and statistics
• Educational content about breathing techniques and meditation practices

The App is provided for informational and educational purposes only to support general wellness and stress management.

3. HEALTH AND MEDICAL DISCLAIMERS

Before using any breathing exercises or meditation practices:

• Consult with a qualified healthcare provider, especially if you have any medical conditions, including but not limited to:
  • Respiratory conditions (asthma, COPD, chronic bronchitis)
  • Cardiovascular conditions (heart disease, high or low blood pressure)
  • Panic disorders or anxiety disorders
  • Pregnancy
  • Any other health condition that may be affected by breathing exercises
• Do not use the App while driving, operating machinery, or engaging in any activity that requires your full attention
• Stop any breathing exercise immediately if you experience dizziness, lightheadedness, shortness of breath, chest pain, or any discomfort
• Seek immediate medical attention if you experience any adverse effects

4. USER RESPONSIBILITIES

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not attempt to gain unauthorized access to any portion of the App
• Not interfere with or disrupt the operation of the App
• Provide accurate information when using the App features
• Use the App at your own risk and responsibility
• Consult with healthcare professionals before starting any wellness program

5. AGE REQUIREMENTS

The App is intended for users who are at least 13 years of age. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. Users under 13 may only use the App with explicit parental consent and supervision.

6. INTELLECTUAL PROPERTY RIGHTS

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the property of the App developers or their content suppliers and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code of the App
• Remove any copyright or proprietary notices from the App

7. USER-GENERATED CONTENT

The App may allow you to store session data and preferences locally on your device. You retain ownership of any personal data you create, and you grant us a license to use anonymized, aggregated data for improving the App and analytics purposes, as described in our Privacy Policy.

8. THIRD-PARTY SERVICES

The App may use third-party services, including but not limited to:

• Firebase Analytics for usage analytics
• Firebase Firestore for feature configuration
• Firebase Storage for content delivery

Your use of these third-party services is subject to their respective terms of service and privacy policies.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE APP DEVELOPERS, THEIR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Personal injury or death
• Medical conditions or health complications
• Loss of data, profits, or business opportunities
• Any other damages arising out of or in connection with your use of the App

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES of MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the App developers and their affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any health complications or medical issues arising from your use of the App

11. TERMINATION

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

Your continued use of the App after any changes to these Terms constitutes acceptance of those changes.

13. AVAILABILITY AND UPDATES

We do not guarantee that the App will be available at all times or that it will be free from errors, bugs, or interruptions. We reserve the right to:

• Modify, suspend, or discontinue any part of the App at any time
• Release updates, patches, or new versions of the App
• Require you to update to continue using the App

14. DATA AND PRIVACY

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of [JURISDICTION], without regard to its conflict of law provisions.
